1. Promoter and Offer

1.1 This promotion is conducted by Flare HR Pty Ltd (ABN 46 607 120 892) of Level 2, 309 Kent Street, Sydney NSW 2000, Australia (Flare, we, us or Promoter).

1.2 Under the offer, an eligible customer who enters into a novated lease with Flare for an Eligible Vehicle may receive a $500 cashback gift card per settled vehicle order (Cashback Gift Card), subject to these terms.

1.3 The offer is not a game of chance, contest of skill, trade promotion lottery, prize draw or competition. No random draw is conducted, no entries are judged, no winner is selected and no permits are required on that basis. There is no limit on the number of Cashback Gift Cards that may be issued; the offer is limited only by the Offer Period and the range of Eligible Vehicles.

2. Offer Period

2.1 The offer applies to eligible novated lease orders placed between 1 October 2026 and 31 October 2026 (inclusive) (Offer Period). An order is treated as qualifying based on the date the order is placed, provided the customer later satisfies the settlement requirements in these terms.

2.2 Flare may vary, extend, shorten, suspend or withdraw the offer, subject to applicable law. Flare may also extend the Offer Period if the offer is performing well, and will publish any such extension on this page before, or as soon as practicable after, it takes effect. Any change will not affect a Cashback Gift Card already earned on a settled, non-cancelled eligible order.

3. Eligible Vehicles

3.1 The offer applies only to new BYD and DENZA models ordered through Flare during the Offer Period (Eligible Vehicle). Used, demonstrator, cancelled, changed or substituted vehicle orders are excluded unless Flare agrees otherwise in writing.

3.2 The list of Eligible Vehicles may be changed for future runs of this Offer without affecting orders already placed under a prior Offer Period.

4. Eligibility Criteria

4.1 To receive the Cashback Gift Card, a customer must be aged 18 years or over, must not be an employee, director or contractor of Flare or of an associated entity of Flare (or an immediate family member of any of them), and must:

• enter into a novated lease agreement with Flare for an Eligible Vehicle, ordered within the Offer Period;
• take delivery of the Eligible Vehicle and have the vehicle order settle; and
• keep the novated lease on foot, without cancellation or termination, up to and including the date of Settlement.

5. Cashback Gift Card

5.1 An Eligible Vehicle order settles (Settlement) when the novated lease finance for the vehicle has been fully executed and the vehicle has been delivered to the customer. The Cashback Gift Card is earned once Settlement has occurred and the associated novated lease has not been cancelled before Settlement. No Cashback Gift Card is payable for an order that is cancelled before Settlement or does not reach Settlement.

5.2 The Cashback Gift Card is provided in the form of a digital gift card, not cash. Flare may choose the gift card provider, brand or format at its discretion and may change the chosen provider from time to time. The gift card will be issued to the customer’s nominated email address or contact details within 60 days of Settlement.

5.3 The Cashback Gift Card will be subject to the applicable gift card provider’s terms and conditions. Expiry dates, activation requirements, redemption conditions, product exclusions and other gift card terms are determined by the applicable gift card provider.

6. Combining with Other Offers

6.1 The Cashback Gift Card cannot be combined with any other Flare-run customer promotion, including the Flare Refer-a-Friend program. Where an order would otherwise qualify for the Cashback Gift Card and another Flare-run promotion, clause 6.3 applies.

6.2 The Cashback Gift Card can be combined with vehicle-specific promotions, discounts or incentives that are not run by Flare, including manufacturer or dealer offers on the Eligible Vehicle.

6.3 Where a vehicle order would otherwise qualify under this offer and a separate Flare-run promotion, Flare will apply whichever promotion is of greater monetary value to the customer, unless the customer nominates otherwise in writing before Settlement.

7. General Conditions

7.1 The Cashback Gift Card is not transferable, exchangeable for cash or redeemable for any other product or service unless Flare agrees otherwise in writing.

7.2 Flare may withdraw, suspend, extend or vary the offer or these terms at any time, including where the offer is performing well, or in response to suspected error, fraud, technical failure, unforeseen legal or commercial circumstances or any issue affecting the proper administration of the offer, subject to applicable law and without affecting a Cashback Gift Card already earned on a settled, non-cancelled eligible order. Where a Cashback Gift Card has been issued in error, or as a result of a customer providing false or misleading information, fraud, or a breach of these terms, Flare may recover the value of the Cashback Gift Card from the customer, to the extent permitted by law.

7.3 To the maximum extent permitted by law, Flare excludes all liability (including for indirect or consequential loss) arising from or in connection with the Offer, the Cashback Gift Card, or the acts or omissions of any third party (including a gift card provider, dealer or manufacturer). Nothing in this Offer limits any rights a customer has under the Australian Consumer Law or other applicable legislation that cannot be excluded.

7.4 The Cashback Gift Card may have tax, payroll, salary packaging or FBT implications. Flare does not provide tax, legal or financial advice. Customers should seek their own independent advice.

7.5 These terms are governed by the laws of NSW, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of NSW.

8. Privacy

8.1 Flare collects, holds, uses and discloses personal information (such as a customer’s name, contact details and novated lease order details) in connection with the Offer in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth) and Flare’s Privacy Policy, available at https://www.flarehr.com/privacy-policy.

8.2 Personal information collected in connection with the Offer may be used and disclosed to administer the Offer, verify eligibility, contact customers, issue the Cashback Gift Card, and may be disclosed to Flare’s service providers (including the applicable gift card provider) for these purposes. A customer may request access to, or correction of, their personal information, or make a privacy complaint, by contacting Flare at [email protected] or as set out in Flare’s Privacy Policy.
